These Terms of Service ("Terms") govern your access to and use of the TimingFlow platform, website, and related services (collectively, the "Service") operated by TimingFlow ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Service.
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

You own your content. All projects, pages, databases, files, text, images, and other materials you create using the Service ("Your Content") remain your property. We do not claim ownership of Your Content.
By using the Service, you grant us a limited, non-exclusive license to host, store, display, and transmit Your Content solely to operate and provide the Service to you. This license terminates when you delete Your Content or close your account.
The Service, including its design, code, features, documentation, branding, and all related intellectual property, is owned by TimingFlow and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written consent.
Pre-built sections, smart components, and templates provided within the Service are licensed for use within projects you create on the platform. They may not be extracted and used outside the Service.
The Service offers free and paid subscription plans. Paid plans provide access to additional features, higher limits, and priority support. Plan details and pricing are available on our Pricing page.
Paid subscriptions are billed monthly or annually, depending on the plan you select. Billing begins on the date you subscribe and renews automatically at the end of each billing cycle unless you cancel before the renewal date.
Certain AI features consume credits. Credit costs are displayed before each AI operation. Credits are non-refundable and expire according to the terms of your plan. Unused credits do not roll over between billing cycles unless your plan specifies otherwise.
If you are unsatisfied with the Service, you may request a refund within 14 days of your initial subscription purchase. Refunds are not available for renewals, credit purchases, or partial billing periods. To request a refund, contact support@timingflow.io.
We may adjust pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle. If you do not agree to the new pricing, you may cancel before the change takes effect.
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
Enterprise customers with SLA agreements may have specific uptime guarantees and service credits for downtime. Refer to your individual agreement for details.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
You are responsible for ensuring that any personal data you collect through sites or applications built on TimingFlow complies with applicable privacy laws. If you collect personal data from EU residents, you must comply with GDPR. TimingFlow provides tools to help you meet these obligations, but compliance remains your responsibility.
You may cancel your account at any time through your account settings or by contacting support@timingflow.io. Upon cancellation:

For non-urgent violations, we will provide 30 days' notice and an opportunity to resolve the issue before termination. For serious violations (malware, fraud, illegal activity), we may terminate immediately.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless TimingFlow and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved in the courts of the Province of Quebec, Canada. Both parties consent to the exclusive jurisdiction and venue of those courts.
For users in the European Union, nothing in these Terms affects your statutory rights under applicable consumer protection law.
